What should I do if I am arrested?
Remain calm and ask for a solicitor immediately. You have the right to free legal advice at the police station. Do not answer questions until you have consulted with us, as anything you say can be used as evidence.
Can I get legal aid for my defence?
Legal aid is available based on the seriousness of the case ("Interests of Justice" test) and your financial situation ("Means" test). We can assess your eligibility and assist with the application, or discuss private fee options if you do not qualify.
What is the difference between the Magistrates' Court and Crown Court?
All criminal cases start in the Magistrates' Court. Less serious offences are dealt with there, while more serious "indictable" offences are sent to the Crown Court, where trials are heard by a judge and jury.
Should I answer "no comment" in a police interview?
This is a strategic decision that depends on the evidence against you. Sometimes "no comment" is best to avoid self-incrimination; other times, providing a prepared statement is better. We provide specific advice on this during the interview.
What happens if I am released under investigation (RUI)?
RUI means the police are continuing their enquiries but you are not on bail conditions. There is no time limit for RUI, which can be stressful. We proactively engage with the police during this period to push for a timely decision on charging.
