How is child maintenance calculated?
The Child Maintenance Service (CMS) uses a formula based on the paying parent's gross weekly income, the number of children, and how often the children stay overnight with the paying parent. We can help you understand these calculations and ensure they are accurate.
Can we agree on child support privately?
Yes, a "family-based arrangement" is often the most flexible option. It allows parents to agree on an amount without CMS involvement. However, these are not legally binding. We can help negotiate and document these agreements to ensure clarity.
What if the paying parent hides their income?
If the CMS calculation does not reflect the paying parent’s true wealth (e.g., due to unearned income or assets), you may be able to apply for a variation or seek a "top-up" order through the courts. We advise on complex cases involving high-net-worth individuals.
Does child maintenance stop at age 18?
Typically, it continues until the child is 16, or under 20 if they are in full-time approved education (up to A-level equivalent). In some cases involving special needs or university education, financial support may continue longer.
What can I do if my ex-partner refuses to pay?
If payments are missed under a CMS arrangement, the CMS has enforcement powers, including deducting earnings or seizing assets. If maintenance is part of a court order, we can help you apply to the court for enforcement action.
