What is a Child Arrangements Order?
A Child Arrangements Order is a court order that sets out where a child will live and who they will spend time with. It replaces the old terms of "custody" and "access." We help you apply for or respond to these orders to ensure your relationship with your child is protected.
Can I stop my ex-partner from seeing our children?
Generally, courts believe it is in a child’s best interest to have a relationship with both parents. You can only stop contact if there is a genuine risk to the child's safety. We can advise on obtaining Prohibited Steps Orders if you have serious welfare concerns.
Do we have to go to court to decide child arrangements?
Not necessarily. We strongly advocate for mediation and negotiation to reach an amicable agreement. Court is usually a last resort when parents cannot agree, as it is often less stressful and more cost-effective to resolve matters privately.
How are decisions made about a child's education or medical care?
These are "Specific Issue" matters. If parents cannot agree, for example on which school a child should attend, the court can make a Specific Issue Order. We help you present a strong case focused on the child's best interests.
What happens if my ex-partner breaches a court order?
If a court order is breached without a reasonable excuse, you can apply to the court for enforcement. The court has powers to order unpaid work or fines, and in extreme cases, transfer residence. We can guide you through the enforcement process.
